REFUGEE CLAIMS AND HUMANITARIAN APPLICATIONS
Canada offers protection to individuals fleeing their home countries in the bases of either:
- Having a well-founded fear of persecution for reasons of race, religion, nationality, membership in a particular social group or political opinion, or
- If sent back to their country of persecution would be at risk of torture, risk to their life, or a risk of cruel and unusual treatment or punishment.
Humanitarian and Compassionate grounds
Canada has allows individuals to apply for permanent residency under humanitarian and compassionate grounds as an exceptional category. Under Section 25 of the Immigration and Refugee Protection Act, the Minister may look at your individual circumstances and grant permanent residence status, if it is justified.
Some factors that will be evaluated are:
- Establishment in Canada;
- Ties to Canada;
- The best interests of any children affected by their application;
- Consequences of the separation of relatives;
